PS5 Competition Terms & Conditions
These terms and conditions (Terms) govern entry into the Overkill Gaming PlayStation 5 Slim Giveaway (Competition) promoted by Monster Merchants Online Limited, trading as Overkill Gaming (Promoter, we, us, our). By entering the Competition, entrants agree to be bound by these Terms and by the decisions of the Promoter, which are final and binding.
1. Promoter
- The Competition is promoted by Monster Merchants Online Limited, trading as Overkill Gaming, a company incorporated in New Zealand (NZBN: 9429052197260). Website: overkill.co.nz.
2. Competition Period
- The Competition opens on 17 June 2026 (Opening Date) and closes at 11:59 pm New Zealand Standard Time (NZST) seven days after the date the Overkill Gaming website launches, or 31 July 2026, whichever is earlier (Closing Date). The Promoter will announce the Closing Date on its social media channels and via email to subscribers.
- The Promoter reserves the right to extend or shorten the Competition Period by giving reasonable notice to entrants. Any extension or change will be communicated via the Overkill Gaming website and social media channels.
3. Eligibility
- The Competition is open to legal residents of New Zealand of all ages. Entrants who are under 18 years of age at the time of entry must have the consent of a parent or legal guardian to enter. By entering, entrants under 18 confirm that they have obtained such consent. The Promoter may request evidence of parental or guardian consent at any time.
- The following persons are not eligible to enter:
- (a) employees, contractors, directors, or officers of Monster Merchants Online Limited;
- (b) immediate family members (spouse, partner, parent, child, or sibling) of any person described in clause 3.2(a).
- If the winner is under 18 years of age, the Prize will be awarded to the winner's parent or legal guardian on the winner's behalf. The parent or legal guardian will be required to confirm consent and provide their own contact details for the purposes of Prize delivery and any public announcement.
- The Promoter reserves the right to verify the eligibility of any entrant and to disqualify any entrant who does not meet the eligibility requirements set out in these Terms.
4. How to Enter
- To enter the Competition, eligible persons must visit the Overkill Gaming coming soon landing page at overkill.co.nz and submit a valid email address using the sign-up form during the Competition Period.
- No purchase is necessary to enter or win.
- Only one entry is permitted per person. Multiple entries from the same email address, or entries submitted by automated means, will be disqualified.
- Entry into the Competition constitutes consent for the Promoter to add the entrant's email address to the Overkill Gaming mailing list. Entrants may unsubscribe from marketing communications at any time by using the unsubscribe link in any email, without affecting their eligibility in the Competition.
- Entries must be submitted by the entrant personally. Entries submitted on behalf of another person will be disqualified.
- The Promoter takes no responsibility for entries that are lost, delayed, misdirected, or not received due to technical or other issues.
5. Prize
- One (1) prize is available: a PlayStation 5 Slim 1TB Console (Prize). The Prize will be fulfilled at or around the time of the Overkill Gaming website launch.
- The Prize has an estimated retail value of approximately NZD $1,199 at the time these Terms were published. Actual retail value may vary.
- The Prize is non-transferable and cannot be exchanged for cash or any other prize.
- If the Prize or any component of the Prize becomes unavailable for any reason outside the Promoter's control, the Promoter reserves the right to substitute a prize of equal or greater value.
- The Prize includes delivery costs, which will be covered by the Promoter within New Zealand.
- The Promoter is not responsible for any costs associated with the Prize that are not expressly stated in these Terms.
6. Draw and Winner Selection
- The winner will be selected by random draw from all valid entries received during the Competition Period. The draw will take place after the Overkill Gaming website launches, at a time determined by the Promoter.
- The random draw will be conducted using a verifiably random selection method. The Promoter will take reasonable steps to ensure the integrity of the draw.
- The Promoter's selection of the winner is final. No correspondence will be entered into regarding the outcome of the draw.
- If a selected winner is ineligible, cannot be contacted, fails to claim the Prize within the timeframe specified in clause 7.3, or does not comply with these Terms, the Promoter reserves the right to conduct a redraw and select an alternative winner.
7. Winner Notification
- The winner will be notified by email to the address provided at the time of entry within five (5) business days of the draw.
- The winner will be required to confirm their eligibility, full name, city or town of residence, and delivery address within ten (10) business days of the notification email being sent. The Promoter is not responsible for notification emails that are not received due to incorrect email addresses, spam filters, or other technical issues.
- If the winner does not respond within ten (10) business days of the notification email being sent, the Prize will be forfeited and a redraw will be conducted in accordance with clause 6.4.
8. Prize Announcement and Publicity
- The winner's full name and city or town of residence will be announced in the Overkill Gaming email newsletter and on Overkill's social media channels following confirmation of the winner.
- The Promoter may request a photograph of the winner for use in the prize announcement and future promotional materials. Providing a photograph is optional. The winner will not be disadvantaged in any way for declining to provide a photograph. Where a photograph is provided, the winner grants the Promoter a non-exclusive, royalty-free licence to use the photograph in connection with the announcement of the Competition and future Overkill Gaming promotional materials.
- By entering the Competition, entrants agree that the Promoter may use their name and city or town of residence in the prize announcement described in clause 8.1, without further consent or compensation.
9. Privacy
- The Promoter collects personal information (including name, email address, and city or town of residence) from entrants for the purposes of administering the Competition and communicating about Overkill Gaming products, services, and promotions. Collection and use of personal information is governed by the Promoter's Privacy Policy, available at https://www.overkill.co.nz/pages/privacy-policy, and the New Zealand Privacy Act 2020.
- Entrants have the right to access and correct their personal information held by the Promoter. Requests should be directed to the Promoter at the contact details provided on overkill.co.nz.
- Personal information collected in connection with the Competition will not be sold or disclosed to third parties except as required to fulfil the Prize (e.g. delivery partners) or as required by law.
10. General Conditions
- The Promoter reserves the right to cancel, suspend, or modify the Competition or these Terms at any time if, in the Promoter's reasonable opinion, it is necessary to do so due to circumstances beyond its control or for any other legitimate reason. The Promoter will provide reasonable notice of any such change where practicable.
- The Promoter is not liable for any loss, damage, or injury suffered by an entrant or any third party in connection with the Competition or the Prize, except to the extent that such liability cannot be excluded by law.
- The Competition is a free-to-enter promotional competition. It is not a lottery or a game of chance requiring payment of consideration. It is conducted in accordance with the Gambling Act 2003 (New Zealand).
- The Promoter's decisions regarding all aspects of the Competition, including but not limited to eligibility, the conduct of the draw, and the award of the Prize, are final and binding.
- These Terms are governed by the laws of New Zealand. Any disputes arising in connection with the Competition will be subject to the exclusive jurisdiction of the New Zealand courts.
- If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed and the remaining Terms will continue in full force and effect.
